Renter worries that they may be leasing a meth lab home
July 1, 2008
I WAS WONDERING IF ANYONE KNEW THE LAWS OF A LANDLORD NOT DISCLOSING THAT THE PROPERTY WE HAVE BEEN LEASING HAD A METH LAB IN BASEMENT BY PREVIOUS TENANTS. WE LIVE IN OHIO AND JUST NEEDED TO KNOW THE LAWS BECAUSE THE LANDLORD NEVER TOLD US THIS I FOUND OUT FROM OUR NEIGHBORS AND WANTED TO KNOW IF THERE ARE ANY SIDE EFFECTS OR IF THESES CHEMICALS COULD BE STILL IN WALLS ETC… I AM VERY WORRIED THAT THESE MAY HAVE EFFECTS ON FAMILY. AND IT MAY HAVE NOT BE CLEANED PROPERLY SINCE WE MOVED IN RIGHT AFTER OTHERS LEFT!! AND SHE NEVER TOLD US OF ANY ACTIVITY IN THE HOUSE.

Got something to say?

Neighbors are one of the best sources of information regarding the cooking of meth in a home. I’m sorry to hear that you and your family, like my son and his family and so many others, may have become innocent victims of the war on meth and meth labs raging across the U.S.
You may want to call the local police department and county health department to confirm what the neighbors have told you. You can ask them if there were any drug busts at that address.
Secondly, if it were me I’d move out of the house as quickly as possible. There are health effects from living in a home contaminated by meth, some of which are severe including respiratory problems, brain damage, and cancer.
Call a lawyer in your area and set up a meeting for a free consultation. Tell them about the situation you’re in. I highly doubt that you will be required to pay the remainder of the lease money owed on a home that is dangerous to your health and that of your family. In fact, you may be able to counter sue for damages that you have incurred.
You might also want to contact Councilwoman Christine Croce about the situation, since she is proposing legislation to protect home buyers. Let her know about the problem you are facing as someone leasing a contaminated property. Maybe she can offer a suggestion to you. At the very least, you can make her aware that meth contaminated properties aren’t the sole problem with contaminated homes. As a renter, your health is also at risk.
Lawsuits involving meth labs are increasing in Ohio - As an example - a single mother is suing the former owner of a drug house that she unknowingly bought, alleging he had failed to tell her that the $147,000 home was a former meth lab. Her children developed chronic respiratory problems, forcing her to vacate the house, lose most of her personal belongings and is faced with foreclosure. Taylor Bean & Whittaker Mortgage Corp. v. Wagner, No. CV2007-07-4932 (Summit Co., Ohio, Ct. C.P.).”
“In the city of Akron alone, there are hundreds of houses, apartments and hotel rooms that have been used as meth production labs, and I think there are tremendous dangers there. And frankly, we have started to hear from people who bought some of those houses.” - Warner Mendenhall of Akron, Ohio’s The Law Offices of Warner Mendenhall. - excerpt from http://www.law.com/jsp/article.jsp?id=1205405291972
If you have any more questions, don’t hesitate to ask. Best of luck to you and your family. I hope the neighbors are wrong, but I fear that they’re not.
